Article 1 – Formation of the Agreement

1. These terms define the conditions under which FotoPulso offers the service available at fotopulso.com.
2. FotoPulso may modify these terms and conditions at any time without prior notice.

Article 2 – Service Description and Scope

1. FotoPulso provides free, temporary transfer of digital files exclusively for professional photographers.
2. The maximum transfer size per submission is 10GB.
3. Files are automatically deleted once the user-selected period expires (between 1 and 30 days).
4. Continuous or uninterrupted availability of the service is not guaranteed.

Article 3 – FotoPulso’s Duties and Responsibilities

1. FotoPulso will handle transferred data with reasonable care and security.
2. It will not exploit or commercialize shared files.
3. It will not disclose personal data except to comply with legal requests or to protect rights.
4. Maximum liability is limited to USD $100 under any circumstances.
5. Access may be limited for technical or security reasons.

Article 4 – User Duties and Responsibilities

1. You must be 18+ and legally capable of using the service.
2. You are responsible for all shared files and must hold rights to distribute them.
3. It is forbidden to share illegal, offensive, or copyrighted content without explicit authorization.
4. Executable files or scripts (.exe, .sh, .php, etc.) and other disallowed types are prohibited.
5. Any breach will result in immediate suspension and possible legal action.
6. You must keep a safe local backup of important files.
7. You will indemnify FotoPulso against claims arising from misuse of the service.

Article 5 – Privacy Policy

1. We do not permanently store your files.
2. Temporary transfer logs are kept solely for security.

Article 6 – Communications

1. You agree to receive important communications by email or notices on our website.
2. For inquiries, write to soporte@fotopulso.com.

Article 7 – Third-Party Claims

1. FotoPulso will remove content that violates third-party rights upon formal complaint.
2. We will cooperate with authorities where legally required.
3. Costs arising from litigation caused by misuse are the responsibility of the offending user.

Article 8 – Electronic Evidence

1. Electronic communications and digital records are accepted as valid evidence.

Article 9 – Force Majeure

1. We are not liable for interruptions due to events beyond our control such as natural disasters, wars, pandemics, or major technical failures.

Article 10 – Severability

1. If any clause is invalid, the remainder shall remain in full force.

Article 11 – Governing Law and Exclusive Jurisdiction

All disputes related to these terms shall be resolved exclusively in the state or federal courts of Rhode Island, USA, expressly waiving any other applicable jurisdiction.
